[MARLON LABS LEGAL ENTITY] respects intellectual-property rights and expects every business that publishes content through Marlon Labs — websites, posts, videos and media — to do the same. This policy explains how to report infringing material and how we respond.
1. Safe-harbor compliance
Marlon Labs hosts content at the direction of its customers. We comply with the notice-and-takedown procedures of the Digital Millennium Copyright Act, 17 U.S.C. § 512, and with equivalent procedures under other applicable laws. We have designated an agent to receive notices of claimed infringement, and we act expeditiously to remove or disable access to material that is the subject of a valid notice.
2. Submitting a takedown notice
Send a written notice to our designated agent (below) that includes:
- a physical or electronic signature of the copyright owner or a person authorised to act for them;
- identification of the copyrighted work claimed to be infringed;
- identification of the infringing material and where it is located (for example the exact web address);
- your name, address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorised by the owner, its agent or the law;
- a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorised to act for the owner.
Knowingly misrepresenting that material is infringing may make you liable for damages under 17 U.S.C. § 512(f).
3. Counter-notices
If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notice with: your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; your name, address and telephone number; and your consent to the jurisdiction of the appropriate court and to accept service from the person who sent the original notice.
We forward valid counter-notices to the complaining party and may restore the material 10 to 14 business days later unless we receive notice that a court action has been filed.
4. Repeat infringers
We terminate, in appropriate circumstances, the workspaces of customers who are repeat infringers, and may remove content or limit features while a claim is reviewed.
